Why will Alec Baldwin be charged again in the Rust case?
In accordance with deadlinethe special prosecutors for the case rust, Kari Morrissey and Jason Lewishave decided that they will take Alec Baldwin before a court so that a jury can determine whether he should be indicted on charges related to the death of Halyna Hutchins. All this as a result of new discoveries about the functioning of the revolver that fired and fatally wounded the photographer:
After an extensive investigation over the past several months, additional facts have come to light that we believe show that Mr. Baldwin bears criminal responsibility for the death of Halwyna Hutchins and the shooting of Joel Souza. We believe the appropriate action is to allow a panel of New Mexico citizens to determine now whether Mr. Baldwin should be brought to criminal trial.
Baldwin’s defense regretted that this is the course to take against their client and finally said that they will indeed have to fight the accusations in court. Last April, the involuntary manslaughter charges that the prosecution had brought against him were dismissed. This left only the production gunsmith, Hannah Gutierrez-Reedin the process of being tried and, if found guilty, with a possible three years in prison as the maximum sentence.
The issue with Baldwin, according to the same specialized media, is how the revolver was fired. The shooting occurred during a test in which the weapon should not have been loaded. He assures that he never pulled the trigger, but the expert investigations that have been carried out on the state of the revolver indicate that it would have been impossible for it to fire without that having happened. His connection to the process will depend on that fact.

The other big question in the case is whether the bullet was real ammunition and, if so, what it was doing inside the weapon that was used for the test. In the wake of Hutchins’ death, other accusations against the production, such as lack of safety meetings, and inappropriate use of weapons, were made. All of this has been part of the investigation that the authorities have carried out. But the resolutions to all these questions remain to be seen.
rust, which returned to finish production and wrapped filming in the spring, is currently seeking distribution. Prosecutors are expected to take the case against Baldwin before a grand jury over the next two months. And this, in turn, has implications for the gunsmith’s trial, which is scheduled to begin in February 2024.
